I understand that you’ve got products to promote, services to sell, and content to share and it might feel harmless to shoot off a quick text to someone who gave you their number. But if you’re texting without proper permission, you could be violating federal law without even knowing it.

Texting your audience without prior express written consent is a violation of the Telephone Consumer Protection Act (TCPA).
Even if someone gives you their number in a DM or while purchasing from your store, that does not give you permission to market via text.

This means no auto-checked boxes, vague language, or pre-filled phone number fields.

✅Review your opt-in forms and ensure that they include TCPA-compliant consent language
✅Avoid casual texts. Keep in mind that just because someone gave you their number does not mean that you can market to them.
✅Use compliant platforms. Tools like Twilion, Postscript and Attentive have build in consent features.
✅Always retain proof of consent in case of an audit or complaint.

Here’s a legally sound example you can copy & paste into your opt-in forms:
“By checking this box, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., cart reminders) from [Your Brand] at the mobile number provided. Consent is not a condition of purchase. Msg & data rates may apply. View Terms & Privacy.”
